What is LMIA?
LMIA – a document that Canadian employers may need to obtain before hiring foreign workers for their company. A LMIA letter confirmation represents a corporation has the necessity of hiring a foreign worker to fill a role due to the unavailability of qualified Canadian citizens or permanent residents. This approval letter can validate the job’s demand and supports the work permit application for the foreign worker.

Reasons for LIMA Policy Reform
On Nov 20, 2024, Canada’s Immigration Minister, Marc Miller, proposed removing LMIA bonus points from Express Entry application due to concerns over fraud documents and fake job offers. The goal is to ensure fairness and transparency in the immigration system in Canada.
Changes in Wage Classification for LMIA
From November 8, 2024 onward, the threshold used to classify jobs as either high-wage or low-wage will rise by 20%.
Moreover, from October 28, 2024 onward, business owners are no longer allowed to use proofs from layers and accountants to certify their business legitimacy.
New Rules for LMIA Low-Wage Positions
Beginning September 26, 2024, following changes will apply to LMIA applications for low-wage positions:

- Applications for low-wage positions in census metropolitan areas where the unemployment rate is 6% or higher will not be processed.

- For some job sectors, the cap on the percentage of low-wage positions is being lowered from 20% to 10%. In the construction and healthcare sectors, the cap is being reduced to 20%.

- The longest duration for low-wage positions is decreased from 2 to only 1 year.
Temporary Pause on Processing LMIA for Montréal
From September 3, 2024 until March 3, 2025, LIMA application for low-wage position in Montreal is temporarily suspended.
