Canada Introduces New Open Work Permit Option for Start-Up Visa Applicants
Entrepreneurs applying for permanent residence (PR) through Canada’s Start-Up Visa Program now have a new option to boost their business development efforts and financial flexibility. As of October 3, 2024, applicants can apply for an Open Work Permit (OWP), allowing them to work in Canada with less restriction. This new option is expected to help start-up visa program applicants to balance their financial needs while focusing on building their businesses.
Open Work Permit Available
This open work permit, valid for up to 3 years, provides significantly more flexibility compared to the previous employer-specific permits, which restricted applicants to working solely for their start-up companies. Open Work Permit enables applicants to work as entrepreneurs to grow their start-up while also allowing them to take on other employment in Canada to supplement their income.
Eligibility for Start-up Visa Optional OWP
- apply for permanent residence through the SUV program
- receive your Acknowledgement of Receipt (AOR) letter
- be an essential member of your entrepreneurial team
- intend to live in a province or territory other than Quebec
- show that your work or business will provide a significant economic benefit to Canada
- bring enough money to settle in Canada
Work Permit and Study Permit for Family
If you apply for a work permit, you may be able to bring your spouse or common-law partner and dependent children, including those too young to attend school, as long as they meet the requirements for temporary residence.
Applied Work Permit before October 3, 2024
For individuals who applied for a work permit before October 3, 2024, the application process was more restrictive. These applicants received employer-specific permits, which only allowed them to work for their start-up companies. However, those who currently hold this type of permit or applied before the deadline can now transition to the new open work permit by submitting a new application and paying the necessary fees.
Additionally, applicants who submitted their requests under the previous rules may be eligible for refunds.
